After the US and the EU took anti-subsidy measures, India is creating a system to verify its tax refund program.

The Finance Ministry and the Ministry of Commerce and Industry are developing a system to verify tax refunds given to exporters under the government’s duty rebate scheme. This aims to prevent countervailing duties (CVDs) from countries like the EU and the US.

The initiative follows the imposition of CVDs by the US and the EU in 2023 on products like paper file folders, aluminium sheets, and steel fluxes due to anti-subsidy investigations. CVDs are tariffs on imports that offset subsidies from the exporting country’s government to protect domestic industries.

The need for a new verification system arose when the US questioned India’s method for verifying rates under the Remission of Duties and Taxes on Exported Products (RoDTEP) scheme. RoDTEP rates are set by the Commerce Ministry based on recommendations from a committee led by former Commerce and Home Secretary GK Pillai, which the US does not recognize.

The Commerce Ministry is consulting with the Department of Revenue to create a verification mechanism for RoDTEP rates. The RoDTEP scheme, announced in January 2021, refunds various taxes and levies, such as VAT on fuel for transport, mandi tax, and duty on electricity.

The US and Europe are major trading partners for India, with exports to the US at $77 billion and to Europe at around $86 billion in FY24.
