  • To hold any procession, rally, or march in Leh, you must get permission from the District Magistrate’s office under Section 144. It’s forbidden to say anything that might disrupt communal harmony or law and order. This rule came just before Sonam Wangchuk’s ‘Pashmina March’ to raise awareness about shrinking pasture lands. No one can organize any event or use loudspeakers or vehicles without permission. This order follows ongoing protests in Ladakh for statehood and inclusion in the Sixth Schedule of the Constitution. Wangchuk, who recently ended a 21-day fast, plans to march to Changthang on April 7 to highlight shrinking grazing lands and threats from big Indian businesses and China. Ladakh Police has also restricted mobile data speed to 2G in Leh.
  • Former Chief Justice of India Ranjan Gogoi, speaking on April 5 during the 76th Foundation Day of Gauhati High Court, distinguished between ‘judicial activism’ and ‘judicial overreach’. He emphasized the judiciary’s role in discerning when to instigate change and when to maintain the status quo. Gogoi highlighted the global recognition of the necessity for judicial systems to adapt to evolving times. He remarked that while judicial activism acts as a peacemaker, judicial overreach trespasses boundaries. Gogoi cautioned that although bold judicial activism may yield positive changes, it also carries the risk of unintended consequences, potentially clouding legal certainty. He noted the transformative impact of Public Interest Litigation (PIL) on the legal landscape, turning the judiciary from a passive arbiter to an active agent for social change. However, Gogoi cautioned that PIL, while instrumental in historic advancements such as environmental protection and human rights, also presents challenges. It can sometimes be perceived as judicial overreach, encroaching on the legislative and executive domains and affecting political morality.
